Are you in the U.S. illegally?

If you or a family member are in the U.S. illegally, it is in your best interest, and that of your family, to correct your immigration status immediately. 

It may still be possible for you to seek legal status in the U.S. 

However, it is vital that you seek counsel from a qualified specialist in Immigration and Naturalization Law as soon as possible, before you get arrested.

Tougher Immigration Laws

Since the September 11 terrorist attacks in New York City and Washington, D.C., immigration policy and immigration laws in the United States have gotten tougher.

  • If you are arrested for even a minor offense, and are in the U.S. illegally, it is very possible the U.S. Border Patrol will discover your lack of legal status and place an immigration detainer against you. 

  • This action could result in your deportation from the U.S. and may be used against you in some future nationalization or citizenship proceeding.

The U.S. Border Patrol makes regular checks of city jails, sometimes daily, and detainers are placed on any illegal aliens found in jail. 

This means: 

  1. those persons will not be released on bond, because of the federal immigration detainer. 

  2. they will need to post a federal immigration bond (usually quite expensive) in addition to whatever state or federal criminal bond they would need to post with regard to the specific charges they face.

Adding to the confusion and complexity of this issue, the federal immigration system also categorizes some crimes as "Aggravated Felonies" for deportation purposes, which means they may be charged as misdemeanors under State Criminal Systems.

Such cases include Assault/Family Violence cases:

  • There have been cases where an individual who has lived illegally in the U.S. for over 20 years, is gainfully employed, and whose children were born in the U.S. and are American citizens, has been deported over a first-offense Assault/Family Violence case.

  • It is critical that you resolve your illegal status in the United States as quickly as possible before you get arrested.
